Innovative Driven is currently seeking an Associate Attorney with at least four years of strong litigation experience to join the team at one of our most well-respected law firm clients, based in Walnut Creek, California!The firm specializes in providing agile, innovative representation for community associations throughout California. The collaborative and experienced team is proud to represent its clients in a variety of cases, including construction defects, HOA governance, and general representation for building and development projects throughout the region.The ideal candidate will be barred in California and possess at least four years of strong, hands-on trial and litigation experience! The position will be mostly onsite in Walnut Creek.RESPONSIBILITIES:

• Litigate complex construction defect claims on behalf of condominium developments
• Litigate third-party liability claims arising from contract disputes with vendors on behalf of homeowner associations
• Prosecute disciplinary/enforcement cases against residents and members of homeowner associations for violations of governing documents and/or nuisance behavior
• Defend legal actions brought against associations and Board members
• Conduct written discovery, take and defend percipient and expert depositions
• Second-chair trials and arbitrations
• Prepare pleadings, motions, and agreements
• Represent clients in court proceedings, including trials, court hearings, arbitration, alternative dispute resolution hearings and mediations
• Facilitate negotiations and manage client expectations
• Prepare witnesses, facilitate discovery processREQUIREMENTS:
  • Active CA Bar
  • At least 4 years of extensive litigation experience
  • Extensive experience with depositions, witness preparation, discovery, motion practice
  • Previous experience with adversarial litigation, especially in construction, HOAs, and non-profit corporations is preferable
